Please read this carefully. By creating an event, downloading the Povi app, or uploading content to an event, you agree to these Terms of Service. If you do not agree, do not use the service. If you use the service on behalf of an organization, you confirm you are authorized to bind that organization.
1 Agreement to these terms
These Terms of Service (the “Terms”) form a legally binding agreement between you and Povi regarding your use of the Povi mobile application and the Povi web application hosted at povi-app.web.app (together, the “App”). Povi may be operated by the Povi team, which you can contact at aneroalfred10@gmail.com.
These Terms incorporate our Privacy Policy, which describes how we collect and handle personal information. Both documents should be read together.
2 Eligibility and accounts
You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to use the App. If you are between 13 and 18, you must have the consent of a parent or guardian, and that parent or guardian agrees to these Terms on your behalf.
Event creators sign in with a Google account. You are responsible for activity occurring under your account, for keeping your account credentials confidential, and for all actions you take through the App. If you believe your account has been compromised, contact us immediately and disconnect your Google Drive authorization from the App.
Guests may contribute media to an event without creating an account or signing in. Guest use is governed by Section 6 of these Terms.
3 Your account and event obligations
As an event creator, you are responsible for your events. In particular, you agree that you will:
- Comply with all applicable laws, including privacy, publicity, and copyright laws in every jurisdiction where your event takes place or where its guests are located.
- Obtain valid consent — and where required, a release or model release — from every person whose likeness, name, or image appears in media you collect or publish, and from every person whose media you upload to an event you host.
- Provide accurate event information and not use Povi to harass, stalk, or endanger anyone.
- Manage access to your events appropriately, and regenerate an event’s access token promptly if you believe a QR code or link has been shared with someone who should not have it.
- Respond to any guest request to have their contribution removed from an event you host.
We may review events flagged by users or automated systems, and may remove content or suspend access where we reasonably believe these Terms or applicable law have been violated.
4 Your content, and our license to it
You retain all rights to the photos, videos, and other content you capture or upload (“Your Content”). Povi does not claim ownership of Your Content. We do not use Your Content for advertising, and we do not use it to train machine learning models.
To operate the service you requested, you grant Povi a limited, worldwide, non-exclusive, royalty-free, transferable license to host, copy, transmit, display, and create technical works from Your Content solely as necessary to:
- store and organize Your Content in the Google Drive folder structure associated with your event,
- process and stream Your Content for you and for the guest-facing gallery and QR code experience,
- reproduce Your Content in the context of the App, including thumbnails and previews, and
- retain a copy after deletion for a limited period where technically necessary, such as in backups or caches.
This license ends when Your Content is deleted, except for copies that must be retained by law or that reside in routine backups that will be overwritten over time. You can revoke the license at any time by disconnecting your Google Drive and deleting your content, though media already delivered to an event host’s Drive is governed by Section 6.
5 Google Drive, Google sign-in and third-party services
The App relies on Google services, including Google Sign-In, the Google Drive API, Google Cloud Firestore, Cloud Functions, and Firebase Authentication. By using the App you agree to Google’s own terms and privacy policies as they apply to those services.
You must maintain a working Google account and a Google Drive account with sufficient storage quota to receive the media you collect. You are responsible for the accuracy of the OAuth authorization you grant and for any quotas, limits, or charges that Google applies to your account. Povi requests only the drive.file permission scope and therefore can access only the files it creates for your events.
Povi may modify, suspend, or discontinue any third-party dependency, and may change the Google Drive folder structure it creates, as our product or Google’s APIs evolve. We are not responsible for the availability or functionality of third-party services.
6 Guest uploads and event hosts
When you upload media to an event you are not hosting, you are contributing that media to the event host. You understand and agree that:
- The event host receives your media, may view, download, organize, publish, and delete it, and may retain it in their own storage indefinitely.
- The event host may display your media in a live gallery and may identify contributors by a label or badge associated with your contribution.
- Your media becomes subject to the event host’s own policies and to the terms of the venue or organization running the event. Povi does not control or moderate how an event host uses media after delivery.
- You grant the event host the same rights to your contribution that you would grant Povi, including the right to store and display it.
- You must not upload content that you do not have the right to share, or that infringes the privacy, publicity, or intellectual property rights of others.
If you believe a guest contribution to an event you host must be removed, contact the event host first. We may assist where a contribution is hosted on Povi infrastructure, but we cannot compel an event host to delete media already stored in their own Google Drive.
7 Acceptable use
You agree not to, and not to permit anyone using your account or event link to:
- Upload or distribute content that is illegal, obscene, fraudulent, defamatory, hateful, or that depicts the sexual exploitation of minors or any content involving a child in a sexual or exploitative context.
- Violate anyone’s privacy, publicity, or intellectual property rights, or upload content you do not have the right to share.
- Record, capture, or upload the likeness or private activity of any person without their consent.
- Impersonate another person or entity, or misrepresent the origin of content you upload.
- Upload malware, malicious code, or content intended to disrupt, overload, or probe the service, including automated scraping, denial-of-service attempts, and circumventing rate, size, or token limits.
- Use the App to send unsolicited communications, to harass others, or to distribute spam or malware.
- Reverse engineer, decompile, or attempt to derive source code from the App, except where that restriction is prohibited by law.
- Use automated means to scrape or enumerate event tokens, or to access events you have not been invited to.
- Resell, sublicense, or provide the App as a service to third parties without our written consent.
We enforce these rules through technical measures, including backend token validation, upload size and type limits, and event expiry. We may suspend or terminate access for any breach of this Section.
8 Suspension and termination
You may stop using the App and delete your account and events at any time. We may suspend or terminate your access, limit your event’s functionality, or remove content where we reasonably believe that you have breached these Terms, that content violates applicable law or third-party rights, or that continued operation poses a security risk to Povi, our users, or the public.
Where a termination is not the result of a serious breach, we will provide reasonable notice and an opportunity to resolve the issue. When we terminate an account for cause, event media already delivered to a guest’s or host’s Google Drive may remain in that Drive.
9 Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or completely secure, or that any content uploaded, stored, or transmitted will be accurate, complete, or available without loss.
You are responsible for backing up your own media and for verifying that uploads completed successfully. Because event media may be stored in your own Google Drive, Google’s own availability, quota, and retention policies apply to that data.
10 Limitation of liability
To the maximum extent permitted by law, Povi and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or media, arising out of or related to your use of the App, the loss or unavailability of any content, or the conduct of any event host or guest. This includes situations where media was captured by a guest and subsequently lost, deleted, or removed.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the App shall not exceed the greater of the amounts you paid us in the twelve months preceding the event giving rise to the claim, or one hundred US dollars (USD 100).
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.
11 Indemnity
You agree to defend, indemnify, and hold harmless Povi and its operators from and against any third-party claim, demand, loss, expense, or liability (including reasonable legal fees) arising out of or connected with your use of the App, your breach of these Terms, your violation of applicable law, your infringement of any third-party right, or the media you capture, upload, publish, or distribute through the App.
12 Intellectual property
The App, including its software, design, branding, the Povi name and logo, and all underlying software, is owned by or licensed to Povi and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the App as intended, for the duration of your access.
These Terms grant no rights to the names, trademarks, or logos of Google, and no rights to the names, likenesses, or trademarks of event hosts or guests whose content appears in an event.
13 Changes to these terms
We may revise these Terms from time to time. The “Effective” date at the top of this page reflects the current version. Where a change is material, we will provide notice through the App, on this page, or by email before it takes effect. If you do not accept the revised Terms, you must stop using the App and may request deletion of your account and data. Your continued use after the effective date constitutes acceptance of the revised Terms.
14 General terms
These Terms are governed by the laws that apply where the Povi team is established, without regard to conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction over disputes arising under these Terms. If any provision is held unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms; we may assign ours in connection with a reorganization, merger, or sale of assets, as described in the Privacy Policy.
